Terms of Service

These Terms of Service ("Terms") govern your use of https://gunrunner.tradebuilds.app (the "Site") and any in-person purchase, transfer, consignment, special order, or service performed at The Gunrunner's licensed retail location at 636 S Main Street, Monroe, OH 45050. By using the Site or transacting with us, you agree to these Terms.
These Terms are provided for general informational purposes and do not constitute legal advice. All transactions are subject to the Gun Control Act of 1968, the National Firearms Act, ATF regulations (27 CFR Part 478), the Brady Handgun Violence Prevention Act, the Ohio Revised Code (including Chapter 2923), and applicable Monroe and Butler County ordinances.
1. No Online Sales
The Gunrunner does not sell firearms or ammunition online. The Site displays inventory for informational purposes only. All firearm transactions must be completed in person at our licensed retail location and are subject to ATF Form 4473 and a successful NICS background check. Inventory, pricing, and availability are subject to change without notice. Photos are representative and may not depict the exact firearm transferred.
2. Eligibility to Purchase
To take possession of a firearm from us, you must:
- Be at least 18 years old for long guns (rifles, shotguns) and 21 years old for handguns and frames/receivers, per 18 U.S.C. § 922(b)(1) and ATF Final Rule 2021R-05F
- Be a U.S. citizen or legally admitted resident
- Present valid, unexpired government-issued photo ID showing your current residence address
- Be a resident of Ohio (or, for long guns only, a state contiguous to Ohio where the transfer is also lawful)
- Truthfully complete ATF Form 4473
- Pass a NICS background check (18 U.S.C. § 922(t))
- Not be a "prohibited person" under 18 U.S.C. § 922(g) or ORC § 2923.13
3. Prohibited Persons
Federal and Ohio law prohibit possession of firearms by, among others, persons convicted of a felony or misdemeanor crime of domestic violence; fugitives from justice; unlawful users of or addicts to controlled substances (including state-legal marijuana per 18 U.S.C. § 922(g)(3)); persons adjudicated mentally defective or committed to a mental institution; persons subject to qualifying restraining orders; persons dishonorably discharged from the Armed Forces; persons who have renounced U.S. citizenship; and illegal aliens. Knowingly making a false statement on Form 4473 is a federal felony (18 U.S.C. § 922(a)(6) and § 924(a)(2)).
4. Straw Purchases Strictly Prohibited
A "straw purchase" — buying a firearm on behalf of someone else who is prohibited or who wishes to conceal their identity — is a federal felony punishable by up to 15 years imprisonment under the Bipartisan Safer Communities Act (18 U.S.C. § 932). We will refuse and report any transaction we reasonably believe to be a straw purchase. Bona fide gifts to non-prohibited persons are permitted; if uncertain, ask staff before completing Form 4473.
5. Background Checks
Every firearm transfer requires a NICS background check. Possible NICS results are Proceed, Delayed, or Denied. We will not transfer a firearm on a Denied response. On a Delayed response, we may, at our sole discretion, choose to wait for a final determination rather than transfer at the end of the statutory waiting period. If you believe a denial is in error, you may appeal directly to the FBI; we cannot reverse a NICS decision.
6. Multiple Handgun Sales
Per ATF requirements, the sale of two or more handguns to the same buyer within five consecutive business days is reported to ATF and local law enforcement on ATF Form 3310.4. This is a routine federal reporting requirement and is not an accusation of wrongdoing.
7. NFA Items
Suppressors, short-barreled rifles, short-barreled shotguns, machine guns, and other items regulated under the National Firearms Act require ATF Form 4 approval, payment of the federal transfer tax, and additional waiting time. NFA items are non-refundable once the Form 4 is submitted. The buyer is responsible for compliance with all state and local restrictions.
8. Transfers from Out-of-State Sellers
We perform incoming FFL transfers from licensed dealers and qualifying private sellers in accordance with 18 U.S.C. § 922(a)(3) and (a)(5). The shipping FFL must send a current copy of their license to us before shipment. Transfer fees, NICS fees, and any applicable Ohio sales/use tax are due at pickup. Transfers will be held for a reasonable period; abandoned transfers may be liquidated to recover fees.
9. Layaway, Special Orders & Deposits
Deposits on layaway and special-order firearms are non-refundable after 7 days unless otherwise stated in writing. Layaway terms (duration, payment schedule, and default consequences) will be provided at the time of agreement. Title does not pass and the firearm is not transferred until the balance is paid in full and Form 4473/NICS is completed.
10. Returns & Exchanges
- Firearms: All firearm sales are final once the buyer takes possession. Federal law treats a returned firearm as a new transfer requiring a new Form 4473 and NICS check. Manufacturer defects are handled directly through the manufacturer's warranty.
- Ammunition: All ammunition sales are final. We cannot accept returns of ammunition for safety reasons.
- Accessories: Unopened, unused accessories may be returned within 14 days with original receipt for store credit or exchange.
11. Consignment Sales
Consigned firearms must be lawfully owned and free of liens. The consignor must complete a consignment agreement and provide ID. We will NICS-check any buyer and log the firearm into our A&D book during consignment. Items unsold after the agreed term may be reclaimed by the consignor; abandoned items are subject to applicable Ohio abandoned-property law.
12. Concealed Carry & Ohio Law
Ohio is a permitless ("constitutional carry") state for qualifying adults aged 21+ under ORC § 2923.111, but a license remains useful for reciprocity. Carrying in posted "no firearms" premises, schools, courthouses, federal facilities, and certain other locations remains prohibited. You are solely responsible for knowing and obeying all carry, transport, and storage laws.
13. Safe Handling & Storage
You acknowledge that firearms are inherently dangerous. You agree to follow the four universal rules of firearm safety, store firearms securely and inaccessibly to unauthorized persons (especially minors per ORC § 2923.21), and use appropriate ammunition for your firearm. We strongly recommend a quality safe or lockbox.
14. Pricing & Payment
Prices are in U.S. dollars and exclude applicable Ohio sales tax (currently collected at the Butler County rate). We accept cash, debit, major credit cards, and certified funds. Pricing errors may be corrected prior to transfer. We reserve the right to refuse any transaction.
15. Right to Refuse Service
We will refuse any sale or transfer if we have a reasonable belief that the transaction is unlawful, that the buyer is a prohibited person, that the firearm would be used unlawfully, that the buyer is impaired, or that the transaction is a straw purchase. Refusal is at the sole discretion of the licensee on duty and may be made without explanation.
16. Intellectual Property
All Site content (text, photos, logos, layout) is owned by The Gunrunner or its licensors and is protected by copyright and trademark law. You may not reproduce, scrape, or republish Site content without written permission.
17. Disclaimers
The Site and our services are provided "as is" without warranties of any kind, express or implied, except those that cannot be lawfully disclaimed. We do not warrant that Site content is complete, current, or error-free. Manufacturer warranties, where applicable, are passed through to the buyer.
18. Limitation of Liability
To the fullest extent permitted by Ohio law, The Gunrunner, its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, our products, or our services. Our maximum aggregate liability for any claim shall not exceed the amount you paid us for the specific product or service giving rise to the claim. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot lawfully be limited.
19. Indemnification
You agree to indemnify and hold The Gunrunner harmless from any claim, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of a firearm or accessory purchased from us, your violation of any law, or your breach of these Terms.
20. Governing Law & Venue
These Terms are governed by the laws of the State of Ohio without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Butler County, Ohio, and you consent to personal jurisdiction there.
21. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site or our services after a change constitutes acceptance of the updated Terms.
