The Gunrunner ("we," "us," or "our") operates https://gunrunner.tradebuilds.app (the "Site") and a licensed Federal Firearms License (FFL) retail location at 636 S Main Street, Monroe, OH 45050. This Privacy Policy explains what information we collect, how we use it, when we are legally required to retain or disclose it, and the rights you have regarding your information.

This policy is provided for general informational purposes and does not constitute legal advice. We are required to comply with the Gun Control Act of 1968 (18 U.S.C. Chapter 44), the National Firearms Act (26 U.S.C. Chapter 53), Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulations (27 CFR Part 478), the Brady Handgun Violence Prevention Act, applicable Ohio Revised Code firearms provisions (including ORC Chapter 2923), and local Monroe and Butler County ordinances.

1. Information We Collect

a. Website Visitors

When you visit the Site or submit our contact form, we may collect:

  • Name, email address, and phone number you voluntarily provide
  • The content of any message you send us
  • Basic technical data (IP address, browser type, pages viewed) for security and analytics
  • Cookies and similar technologies strictly necessary for site functionality

b. In-Store Customers (Federally Required)

Federal law requires us to collect and verify the following information for every firearm transfer, regardless of whether the transaction is completed:

  • Full legal name, current residence address, date and place of birth
  • Government-issued photo identification (typically a state driver's license)
  • Race, ethnicity, height, weight, and gender as required on ATF Form 4473
  • U.S. citizenship status and, where applicable, alien/admission number
  • Social Security Number (optional, used to reduce NICS misidentification)
  • Responses to all background check eligibility questions on ATF Form 4473
  • Make, model, serial number, type, and caliber of the firearm transferred

We submit identifying information to the FBI's National Instant Criminal Background Check System (NICS) as required by 18 U.S.C. § 922(t).

2. How We Use Your Information

  • To respond to inquiries, quotes, and special-order requests
  • To complete lawful firearm sales, transfers, and consignments
  • To conduct background checks through NICS and verify buyer eligibility
  • To maintain Acquisition & Disposition (A&D) records as required by 27 CFR § 478.125
  • To comply with ATF inspections, traces, and lawful subpoenas or court orders
  • To prevent fraud, straw purchases, and other prohibited transactions

We never sell, rent, or trade your personal information for marketing purposes.

3. Record Retention

  • ATF Form 4473: Retained for a minimum of 20 years for completed transfers and 5 years for denied/incomplete transfers, per 27 CFR § 478.129(b).
  • A&D bound book: Retained permanently while the FFL is active; surrendered to ATF upon FFL discontinuance.
  • NICS records: Approval transaction numbers are retained with the corresponding 4473.
  • Website inquiries: Retained no longer than reasonably necessary to respond and follow up — typically 24 months.

4. Disclosure of Information

We disclose personal information only when:

  • Required by federal, Ohio state, or local law (including ATF, FBI, ORC § 2923)
  • Responding to a valid subpoena, court order, or law-enforcement trace request
  • Necessary to investigate fraud, straw purchases, or threats to public safety
  • You have given us explicit consent (e.g., a special order to a manufacturer)

We do not share customer firearm purchase history with credit card processors, advertisers, social media platforms, or data brokers.

5. Data Security

ATF Form 4473s and A&D records are stored in secured, access-controlled premises. Electronic records, when permitted, are encrypted at rest and protected by multi-factor authentication. The Site is served over HTTPS. Despite reasonable safeguards, no system is perfectly secure; we cannot guarantee absolute security of transmitted information.

6. Your Rights & Choices

You may request access to, correction of, or deletion of personal information you voluntarily submitted through the Site by contacting us at info@gunrunner.tradebuilds.app. However, federally mandated firearm transaction records (ATF 4473, A&D book, NICS records) cannot be deleted, modified, or withheld while retention obligations apply, even at the customer's request.

7. Children's Privacy

The Site and our products are not directed to anyone under 18. Federal law prohibits the sale of long guns to anyone under 18 and handguns to anyone under 21 by an FFL. We do not knowingly collect personal information from minors.

8. Cookies & Analytics

We use only essential cookies required for site operation. We do not run third-party advertising or behavioral tracking pixels (including Meta Pixel, Google Ads, or similar). Where basic, privacy-respecting analytics are used, they are configured to avoid collecting personally identifiable information.

9. Third-Party Links

The Site links to third-party platforms (e.g., our Facebook page). We are not responsible for the privacy practices of those platforms. Review their policies before submitting information.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site or our services after a change constitutes acceptance.
